Terms of Service

Article 1 (Purpose)

  • These Terms of Service govern the conditions of use of openalarm (the "Service") provided by OpenStock AI (the "Company"), and the rights, obligations, and responsibilities between the Company and its members.

Article 2 (Definitions)

  • "Member" means a person who registers with an email address and password to use the Service.
  • "Content" means alarms, to-dos, diaries, sound files, and other materials that a Member stores or uploads to the Service.
  • "AI features" means pattern analysis based on alarm usage records, alarm-setting suggestions and automatic application, and AI diary replies.

Article 3 (Posting and Amendment of the Terms)

  • These Terms are posted in the app's Settings and on the sign-up screen. Registration is completed only when the user agrees to the Terms and the Privacy Policy.
  • The Company may amend the Terms to the extent permitted by applicable law. Amendments are announced in the app at least 7 days before the effective date, and changes that materially affect Members' rights or obligations are announced at least 30 days in advance.
  • A Member who does not agree to the amended Terms may close their account; continued use of the Service after the effective date constitutes acceptance of the amendment.

Article 5 (Registration and Account Management)

  • Registration uses an email address and password. Children under 14 may not register.
  • Members are responsible for managing their account credentials and may not transfer or share their account with others.
  • Members may close their account at any time via Settings > Delete Account. Upon closure, account-linked data is deleted without delay in accordance with the Privacy Policy.

Article 6 (Services Provided)

  • The Service provides alarms, to-do management, location-based reminders, a diary with AI replies, user sound uploads, and schedule sharing and proposals — free of charge.
  • AI features may suggest or automatically apply alarm settings based on usage records. The level of automation can be checked in the app's settings.

Article 7 (Changes and Suspension of the Service)

  • The Company may change or suspend parts of the Service for improvements or operational reasons; material changes or suspensions are announced in the app.
  • The Company does not provide separate compensation for changes to or suspension of a free service.

Article 8 (Member Obligations)

  • Members must secure the copyright and usage rights for any sound files they upload; Members are responsible for issues arising from uploads that infringe third-party rights.
  • Account theft, unauthorized access to or tampering with the Service or systems, uploading malware, and interfering with Service operations are prohibited.
  • Content reported for rights infringement may be removed, and repeated violations may result in restricted use.

Article 9 (Company Obligations)

  • The Company endeavors to provide a stable Service and protects Members' personal information in accordance with the Privacy Policy.
  • Service data is stored and processed on external cloud services (Supabase, Vercel, etc.); details of outsourcing and overseas transfer are governed by the Privacy Policy.
  • Member inquiries and complaints are received and handled promptly through the in-app inquiry channel.

Article 10 (Rights to Content)

  • Members retain the rights to the content they upload. The Company uses such content only to the extent necessary to provide and operate the Service (e.g., playing alarms, generating AI replies).
  • Content deleted by a Member is no longer used by the Service and is deleted together with the account upon account closure.

Article 11 (Special Provisions on AI Features)

  • Analyses, suggestions, and replies generated by AI are for reference only and do not constitute a medical service that measures or diagnoses sleep quality, or professional counseling.
  • The Company does not guarantee that AI-suggested or AI-applied alarm settings are always accurate or suitable for the Member.
  • Requests to opt out of or receive an explanation of automated processing can be made via Settings > Contact Admin.

Article 12 (Special Provisions and Disclaimer on Alarms and Notifications)

  • Alarms and notifications may fail to sound or be delayed depending on device settings (Silent/Do Not Disturb modes, battery optimization), notification permissions, OS policies, and network conditions.
  • Location-based notifications may be inaccurate depending on GPS and network conditions.
  • Please verify important schedules, appointments, and work yourself rather than relying solely on the Service. To the extent permitted by law, the Company is not liable for damages caused by alarms failing to fire or being delayed.

Article 13 (Restriction of Use)

  • If a Member violates these Terms or interferes with Service operations, the Company may restrict use or delete the account after prior notice; in urgent cases, notice may follow the action.

Article 14 (Limitation of Liability)

  • To the extent permitted by law, the Company is not liable for damages incurred by Members in connection with the use of the free Service, unless caused by the Company's willful misconduct or gross negligence.
  • Disputes with third parties arising from content uploaded by a Member are resolved by the Member, without the Company's involvement.

Article 15 (Governing Law and Jurisdiction)

  • These Terms are governed by the laws of the Republic of Korea, and disputes related to the Service are handled by the court with jurisdiction under the Civil Procedure Act.

Addendum

  • These Terms take effect on September 20, 2026.
